1. Acceptance of Terms

By accessing or using the Hawk Guru AI-powered business operating system (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Hawk Guru provides an all-in-one business automation platform, including but not limited to:

  • AI Features: Voice AI, Conversation AI, Reviews AI, and Content AI.
  • Marketing Tools: Funnel & Website AI, Workflow AI, and Lead Capture systems.
  • Performance Metrics: Tools designed to improve lead response times (<5s) and booking rates.

3. Subscription Tiers & Billing

  • Tiers: We offer three subscription levels: Starter ($97/mo), Professional ($297/mo), and Elite ($497/mo).
  • Billing: All fees are non-refundable and billed in advance on a recurring monthly basis.
  • Cancellations: You may cancel your subscription at any time via your dashboard; however, no pro-rated refunds are provided for the remaining period of the current billing cycle.

4. User Responsibilities & Conduct

As a user of Hawk Guru, you agree:

  • To provide accurate and complete information during registration.
  • To maintain the security of your account credentials.
  • Compliance: To comply with all local, state, and federal laws, including the TCPA (Telephone Consumer Protection Act) and GDPR, especially when using our Voice AI and automated messaging tools.
  • Usage: Not to use the Service for any illegal or unauthorized purpose, including spamming or harvesting data without consent.

5. AI Usage & Data Rights

  • Ownership: You retain all rights to the data, leads, and content you input into the Service.
  • License: You grant Hawk Guru a limited license to process your data specifically to provide the Service, including training your specific AI models (e.g., Reviews AI) to match your brand voice.
  • Accuracy: While our AI is designed for high performance, Hawk Guru does not guarantee 100% accuracy of AI-generated responses and is not liable for outcomes resulting from AI interactions.

6. Limitation of Liability

To the maximum extent permitted by law, Hawk Guru and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages resulting from:

  • The use or inability to use the Service.
  • Any unauthorized access to or use of our secure servers and/or personal information stored therein.
  • Errors or omissions in any AI-generated content or voice calls.

7. Termination

We reserve the right to terminate or suspend access to our Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
